AMS (Prop 28) Information for CMEA-SBS Members
AMS, or Arts and Music in Schools Funding Guarantee and Accountability Act, is the result of voters passing Proposition 28 in November 2022. It created a new section of California Education Code, Chapter 5.1, and is now law in California.
The intent of this page is to inform our members of some highlights of the law, and also to include some links to more information about AMS.

AMS, or Arts and Music in Schools Funding Guarantee and Accountability Act, is the result of voters passing Proposition 28 in November 2022. It created a new section of California Education Code, Chapter 5.1, and is now law in California.
The intent of this page is to inform our members of some highlights of the law, and also to include some links to more information about AMS.
Highlights of AMS:
- Provides guaranteed annual funding to schools to be used expressly for arts programs.
- Does not take any money away from the general education budget (Prop 98). Instead funds come out of the general state budget, therefore are in addition to general school funding.
- A minimum of 80% of funding must be used for certificated or classified personnel to provide arts education program instruction.
- 19% of funding can be used for “training, supplies and materials, and arts educational partnership programs,” which includes outside contractors.
- No more than 1% can be used for administrative purposes.
- Funding is designated by school site, and can not be reallocated to another site in the district. However, sites may pool funds to share teachers or arts partners as long as the allocation from one school site is not being used to pay for the cost of arts education programs at another school site.
- All funding must supplement spending previously budgeted by the district, not supplant. The district must certify each year that it has first spent the same or more funds for arts programs before using any AMS funds.
- Funds are based on the number of students at a school site the previous year. Students who qualify for free or reduced-price meals are allocated an additional amount.
